Collection, distribution and payment of copyright fees

The author of the film's music retains both personal and economic copyright.

The economic rights of the author of the film's music are managed by a collective management organization.

 

In order for the film author (director, scriptwriter, cinematographer and artist) to authorize AKKA/LAA to collect royalties for the broadcasting of their films on television, public screening, reproduction and publication on the Internet, the author, when concluding a contract with the film producer for the creation of the film, must retain his economic copyrights to the mentioned types of use of the films in the contract. These conditions apply to all films created in Latvia after May 11, 1993, when the Law “On Copyright and Related Rights” came into force.

 

The copyright regulation until May 11, 1993 provided that the author of the script, composer, director, chief operator, production designer and other authors whose works are part of a motion picture or television film each own the copyright to their own work.” (Article 510, Part Three of the Civil Code of the Republic of Latvia).

 

When concluding an authorization agreement with AKKA/LAA for the broadcasting, public display, reproduction, making available to the public of their films by wire or in another way in such a way that they can be accessed at an individually chosen place and at an individually chosen time (films on the Internet), the author must submit to AKKA/LAA their contract with the film producer (a copy) or an extract from the contract between the author and the film producer regarding the author's economic rights.

 

If any of the economic rights have been transferred to the producer, the author can no longer authorize AKKA/LAA to collect royalties for these same rights.

 

AKKA/LAA collects royalties from all film authors only for the rebroadcasting of films in Latvia and other EU countries, because rebroadcasting rights, in accordance with the provisions of the Copyright Law, are administered only collectively.

 

For all authors of protected works, AKKA/LAA collects royalties from cable operators for the rebroadcasting of their works.

   

 

n order for AKKA/LAA to be able to claim royalties due to a film author from foreign organizations, if the film has been shown on a television channel in an EU country, the author must conclude an agreement with AKKA/LAA so that the author can be registered in the internationally accessible author identification database IPI. When sending royalty requests to authors' organizations in other countries, AKKA/LAA must indicate the IPI codes of specific film authors.

 

Royalties to the author of music for an audiovisual work are calculated, distributed and paid in accordance with the license and distribution rules for the public performance, broadcasting and reproduction of the music.
